Basketball Contests:

17.3.5 Number of Contests.

17.3.5.1 Maximum Limitations—Institutional. An institution shall limit its total regular-season playing schedule with outside competition in basketball during the playing season to one of the following (except for those contests excluded under Bylaw 17.3.5.3)

(a) 27 contests (games or scrimmages) and one qualifying regular-season multiple-team event per Bylaw 17.3.5.1.1; or

(b) 29 contests (games or scrimmages) during a playing season in which the institution does not participate in a qualifying regular-season multiple-team event.

17.3.5.1.1 Qualifying Regular-Season Multiple-Team Event. A qualifying regular-season multiple-team event is one in which:

(a) The event is sponsored by the NCAA, an active or affiliated member or a member conference of the Association;

(b) The event includes not more than four contests per institution and concludes not later than 14 days after the first contest of the event;

Hardship Waiver contest calculation:

12.8.4.2.6.1 Denominator in Percent Computation.

12.8.4.2.6.1.1 Team Sports. The denominator in the institution’s percent calculation shall be based on the institution’s number of scheduled or completed varsity contests or dates of competition [see Bylaw 12.8.4-(c)] as computed for playing and practice season purposes in Bylaw 17 for the applicable sport. [Note: Exempted events in Bylaw 17 are included in the percent calculation, except as provided in Bylaw 12.8.4-(c).] An institution participating in a single-elimination event may only count the actual contests in which the institution participates (as opposed to the number of contests scheduled in the event) in determining the number of scheduled or completed contests in the denominator.

12.8.4.2.6.1.1.1 Conference Championships. A conference championship shall be counted as one contest or date of competition in determining the institution’s scheduled or completed contests or dates of competition in that sport, regardless of the number of days or game involved in the championship. However, for purposes of this regulation, the calculation of scheduled or completed contests or dates of competition in a particular season does not include postseason competition conducted after the completion of the institution’s regular-season schedule and conference tournament.

Conclusions:
  1. Mason chose option 17.3.5.1(a), to schedule and compete in 27 games, plus one multi-team event, resulting in four additional games for a total of 31 regular season games.
  2. The A10 Conference Tournament officially counts as one game (for the record, exhibition games do not).
  3. By late Wednesday afternoon, Mason will have competed in 32 games (contests) eligible for calculation for a medical hardship waiver.
It appears that Justin Kier is eligible for a medical hardship waiver. Do we all concur?

from all of the research you have done it looks that way. makes me wonder why Paulsen and Brad seem so doom and gloom

Because the NCAA can be capricious and cruel sometimes? Maybe they're worried the post-season game won't count and so playing in game 16 puts him "over the halfway point of the season?"

Or they're just saying stuff because they won't want to show their cards?

They seem to believe the exhibition game counts, which would make La Salle our 17th “game.” That would mean Kier played one game past the midway point of the season.

Not to side track the medical redshirt talk, but I was looking at Kier's stats this season. His 3 pt % was 45.8%. Obviously he doesn't qualify to be listed given that he only played 9 games, but if he did he would be 10th in the country with that %.

Not hard to imagine that our offense would have looked better with him in the lineup all year.

The offense gets shooters open looks, he was hitting open shots. Sadly, it’s that simple. Would he continue at that clip? Probably not but would have hung around 40%. He worked on it a ton while at Mason. His shot has gotten a little fast and he’s more confident in it. Damn shame.

Has anyone considered that Keir doesn't want to come back?

He has thought about it. I think he needs another year here or elsewhere to prove a few things before starting a pro career. Still a few question marks if Im a pro scout looking at him.

Agreed. I was thinking he’d be more interested in “elsewhere” potentially.

(c) In team sports, the injury or illness occurs when the student-athlete has not participated in more than three contests or dates of competition (whichever is applicable to that sport) or 30 percent (whichever number is greater) of the institution’s scheduled or completed contests or dates of competition in his or her sport. Only scheduled or completed competition against outside participants during the playing season that concludes with the NCAA championship, or, if so designated, during the official NCAA championship playing season in that sport (e.g., spring baseball, fall soccer), shall be countable under this limitation in calculating both the number of contests or dates of competition in which the student-athlete has participated and the number of scheduled or completed contests or dates of competition during that season in the sport. Dates of competition that are exempted (e.g., alumni contests, foreign team in the United States) from the maximum permissible number of contests or dates of competition shall count toward the number of contests or dates in which the student-athlete has participated and the number of scheduled or completed contests or dates of competition in the season, except for scrimmages and exhibition contests that are specifically identified as such in the sport’s Bylaw 17 playing and practice season regulations. Scrimmages and exhibition contests that are not exempted from the maximum permissible number of contests or dates of competition may be excluded from the calculation only if they are identified as such in the sport’s Bylaw 17 playing and practice season regulations.

OK, the c!ear and simple explanation is here regarding Justin Kier's possible return next season as a recipient of a medical redshirt for this season.

Wikipedia states the basic rules:

...medical redshirt. A hardship waiver may be granted to those athletes who sustain a major injury while appearing in less than 30% of team competitions, nor can they have participated after the midpoint of a season. For the purposes of eligibility, players granted such a waiver are treated as though they did not compete in that season.

Does Justin Kier meet the above criteria?

Season Midpoint – Kier's injury occurred after he played in the LaSalle game, the 15th regular season game. Mason will play a minimum of 32 games, including thier first post season A-10 Tournament opener. If exhibition games count for medical redshirt eligibility, then the numbers are, injured on game 17 of a minimum 34 game season. The logical verdict: Kier did not play past the season's midpoint due to an injury. Therefore, this requirement has been met.

No more than 30% of total games played – Kier made his season debut versus Old Dominion at the Cayman Islands Classic. His last game played was at LaSalle. Kier played in 10 games. Kier does not currently meet this requirement, having played in 31.2% of the season prior to injury (10 games played ÷ 32 games minimum). If Mason advances past its A10 Tournament opening game then that would be 33 games played, making Kier still ineligible for a medical redshirt having played in 30.3% games. The logical verdict: Mason would have to win two post-season games (for a season total of 34 games) in order for Justin Kier to qualify for a medical redshirt. If the team's two exhibition games enter into the calculation then Kier is currently qualified to receive a medical redshirt (10 games played ÷ 34 = 29.4%).​

In light of the above logical deliberations, the following question has to be answered: How many games are allowed to be included in the calculation and does this variable include exhibition games? Any way one slices it, 34 games played is the magic number.
Get ready for a CIT/CBI what ever the a10 plays in. I understand all the history. But this is different.

I’m no Mason Lawyer but I DID call Saul and this part seems to indicate that all regular season games that are used in the calculation “concludes with the NCAA championship playing season”.

So it seems to include non scheduled post season games as that would certainly fall under an “NCAA championship playing season”

Of course I will also cite several other precedents such as Plessy vs Ferguson and Alien vs Predator in the deposition.

From what I just heard, the exhibition counts toward our game total, which means La Salle was the 17th game. Also the A-10 tournament only counts for 1 game no matter how many we win, which means we play a maximum of 32.

He’s one over. That’s why the staff is pessimistic about getting the waiver. F*ck.
Obviously the staff didn’t and couldn’t expect this to happen. But they should of prepared for the possibility of a set back. Why not wait until a10 play. Just seems like another example of mismanagement.

It's not the number of games he played in (he's under the 30% threshold either way), it's the last game he played in, La Salle, which is either the 16th game of 32 or the 17th game of 33. If it's the later, he's one game over the halfway mark of the season.

First I don’t think he is under the 30% threshold. Either way if the math is so simple why not wait a few more games to play him? Just on the off chance he had a set back. They could of gave Kier to option to shut it down for the season or rehab and get ready for a10 play.

With 0 scholarships available, you're going to tell your best player to shut it down on the off chance he has a setback to his injury during the season? And you're going to do what, pull a scholarship offer from someone or force a player out the door?

If that’s true that’s a good point. But I thought mason has one available scholarship next year.
