GMU, Hewitt part ways

Unfortunately, the contract has no provision that would allow the school to reassign Coach Hewitt - see http://www.nycbuckets.com/contracts/PaulHewitt-GeorgeMason.pdf.
What about these provisions:

Coach's job duties and responsibilities shall be reviewed, revised and assigned annually by the Assistant Vice President/Director, Intercollegiate Athletics.

The University, in its sole discretion, may reassign Coach to other duties, for a period or periods not to exceed 180 cumulative days during the Term.

Does contract stipulate which campus he has to work at ? Sending him to Korea might be our way out.

You are absolutely correct! The second provision would permit Mason to reassign him to other duties (which I assume would be within the athletic department based on the employment contract). However, I believe that the first provision would only affect his duties and responsibilities in his current position.

So, given the provisions of the contract, if I were BE/AC, I would try to sell Hewitt on something along the lines of:

Paul, this thing can go one of three ways:

1. We could terminate you for convenience and have to pay you, but you have to try to find a job. I'll be hounding you non-stop for proof that you are using "reasonable efforts" to find a replacement job. So, either you are going to have to get a job or spend time finding one. Either way you have to work this next year.

2. We will make your life miserable. We'll be riding your arse for the next 180 days and then we will transfer you to our Korea campus for the following 180 days and you will be in charge of Kimchi preparation in our cafeteria there.

3. We can come to a mutual agreement that you get to finish the year out, you don't get the $85k longevity bonus, but we will pay you $200k to go away when the season is done, and then you are free and clear and spend the next year on the beach.

How about we go with #3 and we all win.

Not to be too picky, but is your friend sure that this would qualify as a charitable contribution?
He apparently linked it to the alumni assoc. Not a smart move. One thing to show your displeasure but trying to link it to the alumni assoc was not a good idea.

I don't think it's necessarily a bad idea either though. If the money is raised, I highly doubt the Alumni Association would turn down an opportunity to assist the University with such a huge issue.
Case in point, Alabama. These guys have a non-profit group set up called the Crimson Tide Foundation. They flat out bought Nick Saban's home for over $3mill and let him live in it for free as a perk to keep him there.

Most likely mandatory, so as not to risk any HR liabilities in the likely event that Hewitt is relieved of his duties with a year remaining on his contract.

No need to give the guy an opening to sue and turn this situation into even more of a sh!t-show.

As noted earlier in the thread, fan/alumni groups have been formed (at Alabama and elsewhere) to either try to keep a coach or buy him out of a contract. But those groups are very careful to note that they operate independently of the university, for obvious reasons.

Completely agree. I admire the few people who donated, but I think it says more that our apathetic fanbase only raised $100 than it does about the terrible coach who helped created that apathy.
